; ; Quels sont les défis que pose le changement de paradigme vers la durabilité environnementale et une économie circulaire pour le droit suisse des obligations et de la consommation ? Cet ouvrage analyse et expose certains défis auxquels est confronté le droit suisse du point de vue de la phase de production et de consommation des produits (notamment l’obsolescence programmée et le greenwashing). Il propose également des solutions et réflexions aux évolutions topiques au niveau de l’UE, utilement illustrées par des références de spécialistes aux évolutions topiques au niveau de l'UE. ; Arbitrators frequently have recourse to good faith in their arbitral awards out of a desire to ‘do justice’ in a given case. Notwithstanding the pervasive use of good faith in international arbitral awards, its application by arbitral tribunals remains elusive and creates a significant and unwelcome degree of uncertainty. This thesis accordingly aims to address some of the uncertainties relating to the application of good faith by arbitral tribunals by (i.) studying how this notion is applied by arbitral tribunals in international commercial arbitration to both the parties’ contract and the arbitration agreement and (ii.) proposing guidelines for the future application of good faith by arbitral tribunals. Les arbitres ont souvent recours à la bonne foi dans leurs sentences arbitrales par souci de «rendre justice» dans une affaire donnée. Malgré l’utilisation généralisée de la bonne foi dans les sentences arbitrales internationales, son application par les tribunaux arbitraux reste difficile à cerner et crée un degré d’incertitude important et indésirable. Cette thèse vise donc à répondre à certaines des incertitudes liées à l’application de la bonne foi par les tribunaux arbitraux en (i) étudiant la manière dont cette notion est appliquée par les tribunaux arbitraux dans l’arbitrage commercial international à la fois au contrat des parties et à la convention d’arbitrage et (ii) en proposant des lignes directrices pour l’application future de la bonne foi par les tribunaux arbitraux. - PublicationAccès libre

The papers cover different important aspects of international arbitration. The Swiss Arbitration Academy is a private institution co-founded and managed by the editors of this volume. Each year, the SAA offers and conducts an intensive and practical course in international arbitration. The training has been designed for lawyers, in-house counsels, and other professionals interested in cutting-edge international dispute resolution education. All participants who successfully complete the course, which includes the submission of the final paper, are awarded with the Certificate of Advanced Studies in Arbitration (CAS in Arbitration) and the Arbitration Practitioner title (ArbP).
