Abstract
Globally, the demand for digital services is concentrated among a small number of extremely powerful companies. The ongoing international debate on competition policy explores whether ex post abuse control under competition law should be complemented by ex ante regulation.
Drawing insights from Lukas Valis’ PhD thesis, supervised by Blaise Carron, which discussed these issues by investigating the existing regulation of the [Tele]Communications sector in Germany and Switzerland, the authors examine recent developments in Germany and propose a balanced solution to mitigate potential negative effects of an ex ante regulation of the digital economy.
