Abstract
L’ouvrage immatériel est une forme particulière d’ouvrage au sens de la définition légale du contrat d’entreprise (art. 363 CO). Cette thèse examine cette notion dans la perspective de la qualification du contrat. Elle est organisée en deux parties. La première partie, générale, établit notamment un historique du traitement de cette question par la jurisprudence et la doctrine et un panorama des prestations qui ont été admises sous le qualificatif d’ouvrage immatériel. Elle se conclut par une discussion critique des différentes positions et une proposition de définition. La seconde partie est consacrée à un approfondissement des formes d’ouvrage immatériel pouvant exister dans le domaine numérique, avec l’examen d’une série de contrats typiques. Le dernier chapitre propose un guide pour la qualification d’un contrat informatique.
The immaterial work is a specific form of « work » within the meaning of the legal definition of the contract for work and services (article 363 CO). This thesis examines the notion from the perspective of contract qualification. It is structured in two parts. The first, general part provides a historical presentation of how the issue has been addressed in case law and legal scholarship, as well as an overview of the types of services that have been accepted under the label of immaterial work. It concludes with a critical discussion on the various doctrinal positions and a definition proposal. The second part focuses on a more detailed analysis of the forms of immaterial work that may arise in the digital sphere, through the examination of a series of typical contracts. The final chapter offers a guide for the qualification of IT contracts.
