Abstract
Case note on Judgment 4A_214/2008 (published as ATF 134 III 570) for the online database Oxford Reports on International Law in Domestic Courts (Oxford: Oxford University Press). The core issue raised by this case was whether the claims arising from an employment contract concluded between the Permanent Mission of the Congo to the United Nations Office and other international organizations in Geneva and a private individual were covered by the Congo's jurisdictional immunity under customary international law. The Swiss Federal Tribunal affirmed that Congo was entitled to jurisdictional immunity in this case and annulled the previous decision.
