Coverage for platform workers and the self-employed in case of unemployment in Switzerld: Access to protection and ways of improvement
Whether they are self-employed, atypical-employees, or using an umbrella company as a self-employed, social protection against unemployment or partial loss of activity is still almost inexistent in Switzerland for platform workers. The same can be said for self-employed in general. This contribution shows that platform workers, irrespective of their exact legal status, and the self-employed more in general either risk sanctions for working in an unsuitable activity, for being insufficiently available for a decent work or unable to prove a loss of revenue. They cannot even contribute to a voluntary unemployment-insurance, should they try against all odds. This contribution shows that the Swiss social protection scheme, an inheritance from years of federal direct democracy, is hardly able to adapt to the fast-moving platform-work environment, thus increasing precariousness risks and the burden on the canton’s social assistance for the future generation. Qu'ils soient indépendants, travailleurs atypiques ou salariés d'une société tierce, il n'existe encore pratiquement aucune protection sociale contre le chômage ou la perte partielle d'activité en Suisse pour les travailleurs des plates-formes. Il en va de même pour les indépendants en général. Cette contribution montre que les travailleurs des plateformes, quel que soit leur statut juridique exact, et les indépendants en général, risquent des sanctions pour avoir accepté un travail inadapté, pour avoir été insuffisamment disponibles pour un travail décent ou pour avoir été incapables de prouver une perte de revenus. Malgré tous leurs efforts, ils ne peuvent pas cotiser à un régime d'assurance chômage volontaire. Nous montrons que le régime suisse de protection sociale suisse, fruit d'années de démocratie directe fédérale, est difficilement capable de s'adapter à l'évolution rapide de l'environnement de travail des plateformes, ce qui accroît les risques précarité et la charge de l'aide sociale des cantons pour les prochaines générations.
Social security coverage for platform workers in Switzerland: A middle way?
This article compares social security coverage for the self-employed and for employees on digital platforms in Switzerland. It sheds light on the particularities that have acted to slow down the evolution of Swiss social legislation to the new emerging forms of work, and summarizes the solutions provided by case law. These solutions are still being fine-tuned, but lean towards the reclassification of contracts as salaried work. Finally, despite the hesitance of the Swiss authorities to take political steps to encourage these new forms of work, which offer significant economic potential, and while also seeking to prevent the risk of precarity in work, we discuss the options available.
