Transnational judicial communication: an empirical study from the perspective of the Swiss Federal Tribunal

Cette thèse dresse un portrait détaillé du Tribunal fédéral suisse dans la communication transjudiciaire, c’est-à-dire qu’elle clarifie quand, combien, comment et pourquoi le Tribunal fédéral suisse a volontairement mentionné des précédents judiciaires étrangers dans sa jurisprudence nationale entre 2000 et 2021. A cet égard, une double approche est retenue. La première partie de la thèse adopte une approche théorique. En plus d’examiner les principales facettes de cette pratique, elle analyse toutes les caractéristiques nationales et juridiques suisses qui théoriquement facilitent l’utilisation de précédents étrangers. La deuxième partie de la thèse adopte plutôt une approche empirique. Premièrement, par le biais d’une analyse quantitative, elle établit combien de fois entre 2000 et 2021 le Tribunal fédéral suisse a volontairement cité des précédents étrangers. Deuxièmement, à travers une analyse qualitative de chaque citation, elle clarifie le rôle qu’elles ont joué dans le traitement des affaires. Enfin, la thèse est complétée par des entretiens semi-structurés avec les juges du Tribunal fédéral suisse.
This dissertation provides a detailed picture of the Swiss Federal Tribunal in transnational judicial communication, namely it clarifies when, how much, how, and why the Swiss Federal Tribunal voluntarily quoted foreign precedents in the adjudication of purely national cases between 2000-2021. In this regard, a twofold approach is retained. The first part of the dissertation adopts a theoretical approach. Besides delving into the main facets of this practice, it analyzes all the Swiss national and legal features which theoretically play as gatekeepers for the use of foreign precedents. The second part of the dissertation takes instead an empirical approach. Firstly, through a quantitative analysis, it sets out how many times between 2000-2021 the Swiss Federal Tribunal voluntarily quoted foreign precedents. Secondly, through a qualitative analysis of each citation, it clarifies the role they played in the deciding of cases. Thirdly and finally, the dissertation is complemented with semi-structured interviews with the Swiss Federal Tribunal judges.
